Tandem flights with Next Outdoor Generation (NOG)

General Terms and Conditions (GTC)

General Information

1. The sole proprietors Christoph Kurz and Leander Dagn offer tandem paragliding flights under the name “Next Outdoor Generation – NOG.” As a rule, the two named sole proprietors conduct the flights themselves, acting as organizers and contractual partners. Flights that are booked through NOG but cannot be conducted by Mr. Kurz or Mr. Dagn will be carried out by independent tandem pilots. In such cases, these tandem pilots are the organizers and contractual partners of the passenger. The organizer and contractual partner is the pilot (entrepreneur) indicated on the flight ticket. This flight ticket must be filled out mandatorily before the tandem flight. It simultaneously serves as an invoice and confirmation for all contractual services listed below (insurance, etc.).

GENERAL TERMS AND CONDITIONS

2. Austrian law applies exclusively – in particular, the legal provisions of aviation law.

3. Before the flight, the passenger (or a legal guardian/adult companion in the case of minors) must read and acknowledge the transport contract by signing it.

4. By submitting the registration/order, by paying the invoice amount, by verbally commissioning the transportation, or by redeeming the ticket, the stipulated terms and conditions are accepted.

5. “NOG” undertakes to transport the person named in the registration or on the flight ticket as a passenger in a tandem paraglider.

INSURANCE – LIMITATION OF LIABILITY

6. As required by law, every passenger is covered by liability insurance for the tandem paragliding flight.

7. The tandem pilot is only liable if the damage results from an act or omission caused intentionally or by gross negligence by the pilot.

8. Passengers are solely responsible for carrying fragile or easily damaged items (e.g., mobile phones, cameras, etc.), and any liability for potential damage is excluded.

9. All items must be stowed or secured in such a way that loss during the flight is impossible and that no danger is posed to people, animals, or property. Carrying explosive or flammable objects is prohibited.

10. No liability is assumed for any damage/accidents occurring on the way to the take-off site or from the landing site.

11. The exclusion or limitation of liability also applies analogously to employees or agents of the pilot.

PASSENGER’S HEALTH CONDITION

12. Only healthy individuals may participate in tandem paragliding flights! The following conditions are exclusion criteria:

  • Cardiovascular diseases
  • Middle ear diseases
  • Pregnancy
  • Alcohol or drug consumption
  • Any other illnesses or conditions that impair fitness to fly

Passengers are obligated to inform the pilot of any possible unfitness to fly. Failure to do so voids any liability on the part of the entrepreneur (pilot). Each tandem pilot has the right to refuse transportation to individuals at any time if there are concerns regarding their fitness to fly.

EQUIPMENT

13. Passengers are required to wear weather-appropriate clothing and footwear. Particular attention should be paid to proper wind and cold protection (gloves) and sturdy footwear. It is also pointed out that clothing may become soiled, but no claims can be made from this.

14. The flight equipment and, if necessary, the helmet will be provided by the organizer.

FLIGHT SCHEDULE AND EXECUTION

15. It is expressly stated that despite fixed appointment times, changes or cancellations may occur due to weather or wind conditions at the flight location. In such cases, no compensation for any incurred expenses will be provided. However, the right to reschedule the flight remains.

16. The flight route and intended landing site may be changed at any time for safety or other important reasons without any entitlement to compensation.

17. The flight duration depends on weather conditions and wind on the day of the flight. Therefore, no fixed flight duration can be guaranteed.

18. Passengers are required to follow the pilot’s instructions during take-off, landing, and throughout the flight.

PAYMENT TERMS

19. When booking a tandem flight without a voucher, the flight price must be paid in cash immediately after the flight.

RIGHT OF WITHDRAWAL / CANCELLATION FEES

20. The passenger may withdraw from the scheduled appointment at any time by sending an email to „nextoutdoorgeneration@gmail.com.” Cancellations up to 24 hours before the scheduled flight are free of charge. For cancellations within 24 hours of the appointment, the cancellation fee is 100%.

RIGHTS TO IMAGE AND VIDEO MATERIAL

21. The passenger expressly agrees to the use of photos and video recordings made by “Next Outdoor Generation” during the flight for promotional purposes.

RISK NOTICE

22. It is noted that despite the utmost care and optimal flight conditions, accidents with significant injuries (e.g., sprains, fractures, cervical spine bruises, spinal injuries, concussions, in extreme cases death, etc.) cannot be ruled out when paragliding. Increased risk exists during take-off and landing due to incorrect landing, stepping, or falling.

FINAL PROVISIONS

23. Austrian law applies exclusively to all disputes arising from this transport contract. The place of jurisdiction is the District Court of Kitzbühel.

24. No employee or agent of the pilot is authorized to supplement, amend, or waive provisions of this contract. Should any provision of this contract be invalid, the validity of the remaining provisions shall not be affected.

25. Should any individual provisions of the GTC be invalid, the validity of all other provisions remains unaffected. An appropriate provision that comes closest to the invalid provision shall take its place.
